If you’ve been laid off from your job recently and replaced by a younger worker, before you scream age discrimination, know the facts.
Replacing older workers with younger workers doesn’t automatically signify that you’ve been discriminated against.
Also be aware that there is no law that requires a company to allow you to apply for another position there. You may actually lack the skills necessary for another position at the firm.
With that said, a company however must have a legitimate reason for your layoff. And if you do have the necessary qualifications and skills to perform a new job and were not given an opportunity to apply for it, then you might have a case.
The Supreme Court did rule that workers over 40 may sue if, in the Court’s words, the layoff has a desperate impact on their age group. But that will only be evident after much research.
